Terms and Conditions

These Terms and Conditions govern the use of the iOS app Lingoala (“App”), provided by Daniel Rinser (“Provider”, “we” or “us”).

By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions.


1. Use by Minors

Lingoala is an educational tool designed for children. However, this agreement is concluded exclusively between the Provider and the parent or legal guardian. If you, as a parent or legal guardian, permit a child to use the App, you agree to these Terms and Conditions on your own behalf and on behalf of the child. You are responsible for supervising the child’s use of the App.


2. Subscriptions and Payments

Some features of the App (“Lingoala Pro”) are only available through a paid subscription.

Processing via the App Store: All payments, subscriptions, and automatic renewals are managed and processed by Apple via your Apple ID account. A valid payment method linked to your Apple ID is required.

Changes to Fees: We reserve the right to change subscription fees at any time. Price changes will take effect at the start of the next subscription period following notification to you, in accordance with Apple’s policies.

Refunds: The Provider does not have access to your payment details and cannot issue refunds directly. Any requests for refunds must be directed to Apple Support and are subject to Apple’s Terms and Conditions.

Changes to Features: We may modify, suspend, or discontinue features of the subscription at any time, with or without notice. This may occur due to changes in third-party service providers (e.g., AI services), technical reasons, or economic considerations. You agree that the Provider shall not be liable to you or any third party for any modification, interruption, or discontinuation of the Service.


3. Artificial Intelligence (AI) and Content

The App uses third-party Artificial Intelligence services (including but not limited to OpenAI and Google Cloud) to generate educational content such as dictation texts, translations, and audio content.

No Guarantee of Accuracy: Artificial Intelligence operates probabilistically. Despite our safeguards, generated content may occasionally be factually incorrect, grammatically flawed, or nonsensical. We do not warrant the accuracy, completeness, or educational correctness of AI-generated content.

Suitability: We employ automated moderation filters to prevent inappropriate content. However, we cannot guarantee that AI generation will be error-free or perfectly suitable for all audiences at all times. You acknowledge that you use the AI features at your own risk.

Disclaimer for Content: The Provider is not liable for damages arising from reliance on erroneous AI outputs (so-called “hallucinations”).


4. Fair Use Policy and Usage Limits

To ensure the stability of the Service and to prevent abuse of AI resources, access to the Service is subject to a Fair Use Policy.

Usage Limits: Although Lingoala Pro may be advertised as allowing “unlimited” creation of certain content, this is subject to reasonable human usage limits. We monitor usage patterns to detect abuse.

Measures in Case of Abuse: In the event of excessive usage that significantly exceeds the average usage patterns of a typical user, or if we detect automated traffic or bots, we reserve the right to throttle or temporarily suspend your access to AI-powered features without prior notice.


5. User Content and Scanning

The App allows you to scan images (e.g., textbook pages) to extract vocabulary.

Rights and Responsibility: You represent and warrant that you have the necessary rights to the images you scan. You agree not to scan content that is illegal, offensive, or pornographic, or that infringes the rights of third parties.

Processing: You understand that scanned images are transmitted to our backend and to third-party providers for technical processing. We do not claim ownership of your content.


The App offers a feature (“Parental Report”) to generate a web link through which learning progress can be shared with third parties (e.g., family members).

Responsibility: The report link provides read-only access to the child’s learning data without requiring a password. You acknowledge that you are solely responsible for keeping this link confidential and sharing it only with trusted individuals.

Revocation: If you suspect that the link has been shared unintentionally or has been compromised, you must immediately invalidate it using the “Revoke link” function in the App settings.

Liability: The Provider is not liable for unauthorised access to data resulting from your distribution or handling of the report link.


The App may contain links to third-party websites or services. We have no control over the content or privacy policies of third-party websites and assume no responsibility for them.


8. Warranty and Liability

Warranty: Statutory warranty rights for digital products apply. However, we point out that the nature of generative AI means that results may vary; this does not constitute a defect in the software.

Limitation of Liability: The Provider is liable without limitation for damages arising from injury to life, body, or health, as well as for damages caused by intent or gross negligence. In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal duties), the fulfilment of which is necessary for the proper performance of the contract and on the observance of which the contractual partner may regularly rely. In such cases, liability is limited to foreseeable, typically occurring damage. Any further liability is excluded.

Educational Aid: The App serves as an educational aid and does not replace certified teaching. We are not liable for a lack of learning success.


9. Changes to Terms

We may update these Terms and Conditions from time to time. The current version is always available at https://www.lingoala.com/terms with the date at the beginning of the document. In the event of material changes, we will notify you through a notice in the App.


10. Severability Clause

If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected.


11. Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
